Disputes currently cost the construction industry in excess of $7 billion per year (DAPs Australia – www.daps.org.au) – and we expect this figure to grow.

Conflicts and disputes between parties are an unfortunate but all too common occurrence within the construction industry.

Given that many projects often begin with the principal wanting a project completed at a fair value, to a defined standard and in a timely fashion, while the contractor is seeking to manage risk by maintaining or improving their commercial position, the potential for conflicts and disputes is present even before works have commenced.  This inherent tension is heightened by factors such as the size, scale and complexity of the project, budgetary and time pressures and quality of the project documentation.
